Definitions

"Cancer Research UK" means Cancer Research UK, a charity registered in England and Wales (no 1089464), Scotland (no SC041666) and the Isle of Man (no 1103).
"Charity Product" means a Product allowing a Guest to make donation to Cancer Research UK.
"Gift(s)" means one or more of the products chosen by the List Holder(s) and purchased by a Guest.
"Gift List" means the list of products compiled by the List Holder(s).
"Guest" means the person buying from the Gift List.
"Honeymoon" means a Kuoni honeymoon selected and fully paid for, by or on behalf of, the List Holder(s).
"Honeymoon Product" means a Product allowing the Purchaser to contribute towards the List Holder(s)' Honeymoon.
"List Holder(s)" means the person(s) who registered and compiled the Gift List.
"Product" means an item displayed for sale on a Gift List.
"Store" means the John Lewis store holding the gift list.
"Terms and Conditions" means these terms and conditions and the service checklist outlined in Appendix 1.
"United Kingdom" means England, Wales, Scotland, Northern Ireland and The Channel Islands.
"User Information" means information about you, such as your computer's IP address, your browser type, the country and area code from which your computer is calling, the webpages you viewed, the advertisements you selected, and any search terms that you entered on the Website.
"Users" means the users of the Website collectively.
"We/us" means John Lewis plc.
"Website" means the Gift List website located via a link from www.johnlewis.com or www.johnlewisgiftlist.com or any subsequent URL which may replace them.
"You" means the List Holder(s)

Introduction

John Lewis Gift List is a service run from John Lewis stores and the John Lewis Website. List Holders register and compile Gift Lists in a John Lewis store, or using the Website. When Guests purchase from the Gift List, the information is passed to the Store or Website which holds the Gift List. John Lewis endeavours to source and collate Gifts, delivering them to the List Holder(s) at a mutually convenient date and time. In addition to allowing List Holders to compile their Gift List online, the Website allows List Holders to view the progress of their Gift List and allows Guests to purchase Products from Gift Lists. The gift list Website facility is a separate operation from John Lewis Direct. Please see the service checklist in Appendix 1 to these terms and conditions for more information about how your Gift List will work.

You agree that your use of the Gift List service is governed by these Terms and Conditions and the service checklist outlined in Appendix 1.

Use of the Website

Access

You are provided with access to the Website in accordance with these Terms and Conditions.

You warrant that:
  • The personal information that you are required to provide in order to use the website is true and accurate
  • You will notify us immediately of any changes to such personal information by contacting our Gift List Representatives. Contact details can be found at the end of these Terms and Conditions
  • You agree not to impersonate any other person or entity or to use a false name or a name you are not authorised to use
Privacy policy

Please note that calls to our Gift List Representatives may be recorded for quality monitoring and training purposes.

We will treat your personal information as confidential, although we reserve the right to disclose information in certain circumstances as set out elsewhere in these Terms and Conditions. We will keep your personal information on a secure server, and we will fully comply with all applicable United Kingdom Data Protection and consumer legislation from time to time in place.

When you register or compile your Gift List on the Website, we'll ask you to input, and we'll collect, personal details from you such as your name, email address, telephone number and Product selections. We may also collect, and our third party providers of advertisements and content may collect, other information about you (for example, the URL you came from, the IP address of your computer, your browser type, the country and area code from which your computer is calling, the pages of our website which were viewed during your visit, the advertisements you clicked on, and any search terms that you entered on the Website). Such information is referred to collectively as "User Information".

Any personal information you provide to us (whether through the Website or otherwise), or that is available on public registers, and any User Information from which we can identify you, is held in accordance with our registration with the Information Commissioner under the Data Protection Act 1998. We will use your information only for the following purposes:
  • Processing your Gift List and the Gifts purchased
  • For statistical purposes to improve the Website and its service to you
  • To provide Website content and advertisements to you
  • To administer the Website
  • If you consent, to notify you of products or special offers that may be of interest to you
You agree that you do not object to us contacting you for any of the above purposes whether by telephone, email or in writing and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.

Your personal details may be disclosed to other businesses within the John Lewis Partnership and to reputable third parties who are necessary to process your Gift List or the Gifts purchased. We require all such third parties to treat your personal information as confidential and to fully comply with all applicable United Kingdom consumer and Data Protection legislation. We will not release your personal details to any company outside the John Lewis Partnership for mailing or marketing purposes.

Where you include the Charity Product on your Gift List, your personal details will be given to Cancer Research UK for the purposes of processing your Guests donations and claiming any Gift Aid.

We may disclose your personal information or User Information where we are required or permitted by law to do so. In particular, we may share your personal information or User Information where we reasonably believe that to do so may prevent or solve crime.

Our rights

We reserve the right to:
  • Modify, or withdraw, temporarily or permanently, the Website (or any part thereof) without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website
  • Change these Terms and Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. If you do not agree to any change to the Terms and Conditions then you must immediately stop using the Website
Third party links

To provide increased value to Users, we may provide links to third party websites or resources for you to access at your sole discretion. You agree that we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites or resources, (ii) the advertising or content of such websites or resources, (iii) any products, goods or other materials or services available from such websites or resources or (iv) for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any advertising, content, products, goods or other materials or services available on such websites or resources.

Purchase of Products by Guests

Age related legislation

Gift Lists may include age-restricted Products such as alcohol, knives, or pre-recorded video media. In particular, Guests purchasing age-restricted Products from the Website are reminded that:

It is an offence for any person under the age of 18 years old to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18;

In order to purchase liqueur chocolates, you must be at least 16 years old;

It is an offence for any person under the age of 18 years old to purchase a knife, axe or blade that could be used to harm others;

It is an offence for any person under the age of 18 years old to buy, or attempt to buy an item that could be used for solvent abuse, or for any person over the age of 18 to buy these products on behalf of any person under the age of 18; and

It is illegal for a person to purchase pre-recorded DVD/video media where that person is younger than the age limit specified in the DVD's or video's certification.

In adding a Product to your Gift List to which an age restriction applies, you warrant that you have attained an age which legally entitles someone to buy you, us to sell them, and you to receive, the Product. You undertake to provide us with truthful and accurate information, and to act in full compliance with all legislation relating to the sale of age restricted items.

We will only sell age-restricted Products to Guests who have reached the minimum age for purchasing those Products. Guests purchasing age-restricted Products must verify their age by either (i) visiting one of our shops in person; or (ii) calling our guest line on 0345 600 2202 and paying using a credit card. (Please refer to your service provider for call charges.)

We reserve the right not to deliver age-restricted Products to you or a person taking delivery on your behalf if you or that person (i) do not appear to have reached the minimum age for purchasing those Products, and (ii) are unable to provide suitable proof of age.

Description of Products and pricing

We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system.

Products on your Gift List are subject to our department store and website pricing policy "Never Knowingly Undersold". As a result, prices may change during the purchasing period of a Gift List in response to our competitors. Prices shown are updated daily as necessary to reflect the current price. Guests will be charged the Product price applicable on the day the purchase is made.

Product returns and cancellations

We want you to be happy with your gifts. If you've changed your mind about keeping any of them, please let us know. Unless faulty, we'd like this to be within 35 days of receiving your delivery.

You can return up to 25% of the total value of your Gift List in exchange for another item, or gift card equivalent to the price paid by the respective guests.

Please return any unwanted item, unless faulty, in its original condition together with any packaging and labels.

We can't offer exchanges, unless faulty, on the following items: products which have been personalised for you, perishable goods such as fresh flowers and food, or computer software that has been opened.

Where a product has been specially ordered for you, unless faulty, we are unable to offer an exchange. We are unable to accept cancellations for these orders unless within 48 hours of your order being placed. We will make this clear with you when you place your order.

Charity donations can't be cancelled or refunded without written permission from Cancer Research UK and if cancelled will be refunded to the guest and you cannot exchange them for a John Lewis gift card or other items.

If you cancel your honeymoon, please contact us as soon as possible. We'll remove the honeymoon option from your Gift List and we, or Kuoni (depending on when you notify us), will refund your guests (we can offer guests the option to select an alternative gift if you wish).

You will need to direct any returns to the relevant selling department at John Lewis with the final list summary - this is your proof of purchase.

All refunds on Gift List are given in the form of Gift Card.

This does not affect your statutory rights.

If you need to cancel your Gift List for any reason, please let the Gift List department know as soon as possible. This will enable us to close your list to prevent further purchases being made and to discuss how you would like your list to be dealt with. Please confirm cancellation of your list in writing.

All gifts are professionally packed (although not gift wrapped) for safety and security. If anything is damaged, please notify us within 2 weeks of delivery.

Guest cancellation rights

Please be aware that, under the Consumer Contracts Regulations 2013, each Guest has the right to cancel their purchase of a Gift made online or by phone, if they notify us no later than 14 working days after the day you receive the Gift. This right to cancel does not apply to Honeymoon Product, Charity Product or the items listed above. If a Guest exercises their right to cancel after their Gift has been despatched, you must return the Gift to us and must have taken reasonable care of the Gift. It is the Guest's sole responsibility to arrange and bear the cost of the return of the Gift and we accept no responsibility for organising this with yourself or the Guest.

Availability of Products

In some circumstances (including, without limitation, the situation where we are unable to obtain the Gift for reasons beyond our control) we may substitute a Gift with an item of equivalent value, or with a John Lewis gift card of equivalent value, to the price paid for the Gift by the Guest. If this becomes necessary, we will discuss it with you prior to making the substitution. If you do not want the replacement item and you notify us of this in writing no later than 7 working days after the day you receive the item, we will bear the cost of returning the item.

Honeymoon Product

If you set up a Gift List prior to 27th March 2020, and linked it your Kuoni Honeymoon, you can offer your guests the option to contribute to it through your Gift List.

We will hold all money contributed to your Honeymoon Product by Guests until your Gift List is closed. We will then transfer the total amount contributed by Guests in one lump sum to Kuoni upon closure of your Gift List.

If you have not yet departed, Kuoni will contact you to offer to arrange additional events and services for your Honeymoon. Any remainder up to the total final value of your Honeymoon then will be refunded by Kuoni to yourself via your original payment method within a reasonable period of time. Any contributions over the total final value of your Honeymoon will be refunded as a John Lewis gift card.

If you have departed, Kuoni will refund any contribution up to the total final value of your Honeymoon via your original payment method within a reasonable period of time. Any contributions over the total final value of your Honeymoon will be refunded as a John Lewis gift card.

Honeymoon Products may not be exchanged for Gifts or a John Lewis gift card other than in the precise circumstances described in the two preceding paragraphs.

You may remove a Honeymoon Product at any time before your Gift List is closed. If you remove a Honeymoon Product, any contributions already made will still pass automatically to Kuoni unless you arrange with us to refund your Guests at least 5 working days before your Gift List closes. If you cancel your Honeymoon you must let the Gift List department know as soon as possible so that they can remove the Honeymoon Product and refund affected Guests.

You will not be entitled to claim or be paid any interest which accrues on the contribution.

Charity Product

If you set up a Gift List prior to 27th March 2020 and added the Charity Product to your Gift List, your Guests can make a donation to Cancer Research UK.

You may remove a Charity Product at any time before the Gift List is closed but any donations made by Guests will still pass to Cancer Research UK and may not be refunded to your Guest without Cancer Research UK's written consent. Donations may not be exchanged for Gifts or a John Lewis gift card or refunded to you at any time.

We will hold all payments of money made by Guests purchasing the Charity Product on trust for Cancer Research UK (and to their order) until your Gift List has closed. We will then, within a reasonable time of the closure of the Gift List, transfer all of such money in one lump sum to Cancer Research UK.

You will not be entitled to claim or be paid any interest which accrues on the donation.

General

Intellectual property and right to use

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors, or (where applicable) Cancer Research UK.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to process your Gift List) download such material and content onto only one computer hard drive. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

The Cancer Research UK logo and name are the property of Cancer Research UK and may not be used without Cancer Research UK's express permission.

Compliance with laws

The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations.

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the Website or give you in person, in one of our shops or over the telephone, we make no warranties, whether express or implied, in relation to the accuracy of that information.

The Website is provided on an "as is" and "as available" basis and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represent the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor your contract cancellation rights.

We will not be liable in contract or tort (including, without limitation, negligence) or as a result of pre-contractual or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with these Terms and Conditions for:
  • Any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings)
  • Any loss of goodwill or reputation
  • Any special or indirect losses
suffered or incurred out of or in connection with the provisions of any matter under these Terms and Conditions.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Waiver

No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

Entire agreement

These Terms and Conditions govern our relationship with you and state the entire extent of your and our respective rights and obligations.

Nothing in this paragraph shall limit or exclude our liability in respect of any fraudulent misrepresentation.

Governing law

The Terms and Conditions shall be governed by the laws of England and Wales, and you and we irrevocably submit to the exclusive jurisdiction of the courts of England and Wales in determining any dispute arising out of these Terms and Conditions or the John Lewis Gift List operation.

You can call our Gift List representatives on 0345 604 7384, any time between 9am and 5pm Monday to Friday. (Please refer to your service provider for call charges.) Our aim is to handle at least 80% of all calls within 20 seconds so you won't have to wait long to receive the answer to your question. Please note that all calls to our Customer Services Representatives may be recorded for quality monitoring and training purposes.

Service Checklist

The service we offer is shown below:

List Set Up
  • Our Gift List service is free to you (the list holder) and your guests
  • We'll supply invitation inserts for you to send out to your guests, informing them of the Gift List details
  • You should only compile your list 6 - 8 weeks prior to your event to ensure your product choices are from our most current ranges. You should avoid adding Reduced to Clear or Special Buy items to your list as we cannot guarantee their availability. Products that are exclusive to online or delivered directly to customers homes by selected suppliers are not available on the Gift List
  • John Lewis Gift Card contributions will be automatically added to your list as an option for your guests
  • When you have finished creating your list, we'll send you the final copy to review
  • Products may become discontinued at any point during the life of your list, and we will indicate this on your Gift List summary. If this happens before an item has been purchased, we recommend that you remove it and select something else instead
  • Honeymoons must be booked directly with Kuoni. Kuoni honeymoons booked through an intermediary 3rd party travel agent cannot be added to your Gift List
Guest Purchasing
  • Guests will be able to purchase from the list 6 weeks prior to and 2 weeks after the event
  • There are 2 ways to shop from the list:
    1. Online via www.johnlewis.com
    2. Phone us: the guest line is: 0345 600 2202. Lines are open Monday to Friday 9am - 5pm. (Please refer to your service provider for call charges.) The Gift List can be emailed to guests
List Management
  • Once you've registered and set up a password you can view your Gift List online at www.johnlewis.com/GiftList. You'll be able to edit your list, add more items or see what's been purchased
  • We'll send you a regular summary showing the progress of your list
  • We'll pass any Charity donations to Cancer Research UK when your Gift List has closed to guests
  • We'll pass any honeymoon contributions to Kuoni when your Gift List is closed to guests. Kuoni will either deduct the amount contributed from the balance to pay for the honeymoon, or if the cost has already been paid, they'll refund the amount contributed to the original payment method. If the total value of contributions is greater than the total value of the honeymoon, then the excess will be refunded to you as a John Lewis gift card
  • If 4 weeks have passed since you received your final delivery and all gift card contributions have been issued, we'll complete your list and send your final summary which will act as your proof of purchase
Product Availability
  • We'll advise you on the availability of lines (it is possible that products may be discontinued during the life of the list). This will be shown in the Gift List summary
  • If an item is out of stock when purchased, we will make every attempt to source the product for you, but success cannot be guaranteed
  • If you select a dinner service that we don't normally stock we'll place the order after the event, giving you a chance to add to the order. We only offer this extended range on selected dinner service suppliers. These items are special ordered directly from the supplier and can take time to source so will be delivered as a separate later delivery. Please be aware that unless faulty, we can't refund or exchange items that are specifically ordered. This does not affect your statutory rights
  • If we're unable to obtain an item on the Gift List, we'll substitute it with an item of equivalent value, or with a John Lewis Partnership gift card contribution, to the price paid by the guest. If this happens, we'll discuss it with you before making the substitution, but we won't notify your guests
Delivery
  • We offer a free collated standard delivery service within the John Lewis delivery area. However timed or special deliveries can be arranged at a charge. We will endeavour to deliver in one main delivery but if items need to be ordered, these will arrive in additional later deliveries. At times we may use a carrier to make a delivery on our behalf
  • We can store items for up to 8 weeks after your event. You must take delivery of your gifts within this time. If you're unable to do so - we would recommend that you opt for a Gift Card list. We reserve the right to exchange your stored products into a gift card if you are unable to take delivery within 8 weeks of your event
  • In the event there is more than 500 of value of your John Lewis Gift Card, we will need to issue more than one gift card
  • At present we do not offer an international delivery service. Should you wish to export your Gift List, it must be delivered to an address in the UK where you will need to arrange you own export
  • If you would like some items to be delivered before your event, please let us know by using the early delivery indicator when compiling your list
  • We'll deliver gifts approximately 3 weeks after the event, and you can either collect gift cards from our Gift List department on production of photographic identification, or have them posted to you via recorded delivery once the Gift List has closed to guests
  • Delivery should be arranged with us with a minimum of 2 weeks' notice, as we can only deliver a set number of Gift Lists per day. It is advisable to book your delivery date as soon as possible after compiling your list
  • If there are any outstanding gifts, we'll arrange for them to be delivered or collected at an agreed later date, with a minimum of 2 weeks notice
  • We're sorry that we're unable to organise early deliveries for a "show of presents"
  • We'll securely pack (but not gift wrap) gifts to ensure they arrive safely at their destination. If you notice that any items are damaged or missing, please notify us as soon as possible within two weeks of delivery so we can help sort out any issues
Returns and Cancellations
  • We want you to be happy with your gifts. If you're not, you can return up to 25% of the total value of your gift list in exchange for another item or a gift card equivalent to the price paid for the Gifts by the respective Guest
  • If you've changed your mind about keeping any of your gifts and would like to return them, please let us know. Unless faulty, we'd like this to be within 35 days of receiving your delivery.
  • It's important that any unwanted item, unless faulty, is returned in a re-saleable condition. We'd expect this to mean:
    i) You've kept all the original packaging and labels
    ii) it is undamaged and unused
  • We can't offer exchanges, unless faulty, on the following items: products which have been personalised for you, perishable goods such as fresh flowers and food, or computer software that has been opened
  • Where a product has been specially ordered for you, unless faulty, we are unable to offer an exchange. We are unable to accept cancellations for these orders unless within 48 hours of your order being placed. We will make this clear with you when you place your order
